High Court asked to convert an ODPC compensation award into a court order

In Muthoni v Africa International University [2026] KEHC 2254 (KLR), decided 16 February 2026, the High Court considered an application to adopt a July 2025 ODPC determination (Complaint No. 0590 of 2025) as an order of court, for enforcement of a KES 250,000 compensation award.

The mechanism comes from regulation 14(5)(b) of the Data Protection (Complaints Handling Procedure and Enforcement) Regulations, 2021, under which the Data Commissioner's decisions are enforced as orders of the court. Once registered, an ODPC compensation award carries the High Court's full execution machinery, including attachment of assets.

Combined with the ODPC's announced 184 compensation orders, the case indicates that data subjects who succeed before the regulator now have an established path to collect on the award.
